The present general conditions of sale apply to all offers and sales of products on the website www.lepetitibiza.com (here in after “the Site”), property of SAS HOMEWORK operating under the trade name LE PETIT IBIZA, registered with the RCS of Paris under the number 888 099 397, whose head office is located at 19 bis rue Jouffroy d’Abbans 75017 PARIS (hereinafter “LE PETIT IBIZA”), made to any consumer, natural person, who visits or makes a purchase via the Site (hereinafter “the Client”).

Any order placed on the Site implies the unconditional acceptance by the Customer of these general terms and conditions of sale (hereinafter “the GTCS”).

The GTC may be modified at any time and without prior notice by LE PETIT IBIZA, the applicable conditions remaining those in force at the date of the order by the Customer.

PRODUCTS MARKETED BY LE PETIT IBIZA

The products offered for sale are presented on the www.lepetitibiza.com website with a description that is as precise as possible; however, certain details (such as colour, prints or texture) may vary according to the resolution of your screen and thus differ slightly from the finished product. The sizes indicated correspond to market standards.

The products offered by LE PETIT IBIZA comply with the standards applicable in France.

OBLIGATIONS OF THE CLIENT

The Customer declares that he/she has the legal capacity to contract or is the holder of an ad hoc authorisation allowing him/her to place an order on the Site.

The Customer undertakes to provide the real information necessary for the performance of the service as requested and according to his/her situation, in particular his/her surname, first name, address, telephone and valid e-mail.

The Client is responsible for the consequences that may arise from the transmission of false or inaccurate or illicit information.

The Customer can modify his data in the “my account” section.

ORDER

Any order can only be validated after confirmation of payment.

LE PETIT IBIZA reserves the right to cancel or refuse an order in case of a dispute with the Customer about a previous order.

LE PETIT IBIZA can only accept orders within the limits of available stocks or on pre-orders.

If, despite its vigilance, the products are unavailable, LE PETIT IBIZA will inform the Customer by e-mail as soon as possible. The Customer may then cancel the order, be reimbursed the amount already paid or use it for another purchase.

LE PETIT IBIZA shall not be held liable for the permanent or temporary unavailability of the products, nor shall it give rise to any right to compensation or damages in favour of the Customer.

PRICE

The prices displayed on the Site are indicated in euros, including all French taxes (VAT), but excluding delivery costs.

The shipping costs will be specified in the Customer’s shopping cart once the delivery information has been entered.

LE PETIT IBIZA reserves the right to modify the prices at any time, without prior notice and in particular in case of changes in fiscal or economic data. Each item will be invoiced at the price in force at the time of the validation of the order.

EXPEDITION

The products are dispatched within the following timeframes, depending on the case:

  • In the case of direct orders, orders are processed and handed over to the carrier before the 15th of the following month if the order was placed in the second half of the previous month and before the 1st of the following month if the order was placed in the first half of the month;
  • In the case of a pre-order, the order is dispatched within 15 days of the end of the Campaign.

SHIPPING

The delivery price is calculated after entering the delivery information.

In the European Union, home delivery and delivery to a relay point are offered for all orders over 100€. For the rest of the world, delivery is offered for orders over 100€.

The products are sent to the delivery address indicated by the Customer when ordering. The delivery times indicated on the Site are indicative times, corresponding to the average processing and delivery times. In order for these times to be respected, the Customer must ensure that he has provided accurate and exhaustive information concerning the delivery address (street, building, stairs, codes, intercom, etc.).

There can only be one delivery address per order. 

In the case of international deliveries, packages may be opened and inspected by customs authorities and may be subject to import taxes at the Customer’s expense.

The delivery time at home or in a relay point for orders to a country of the European Union is 2 to 4 days after shipment.

The delivery time for orders to a country outside the European Union is 3 to 8 days after shipment.

LE PETIT IBIZA cannot guarantee the delivery times of its COLISSIMO service provider and cannot be held responsible for exceeding these times, which are provided here as an indication only.

PAYMENT

Orders are paid for via the STRIPE payment module. The data recorded by Stripe constitute the proof of the financial transactions carried out by credit card. However, Stripe does not transmit the credit card data to LE PETIT IBIZA. Most credit and debit cards are accepted.

RETRACTATION

The Customer has fourteen days from the date of delivery of the Product(s) to inform LE PETIT IBIZA that he/she wishes to withdraw from the purchase. The Customer must return the Product(s) to LE PETIT IBIZA at the address indicated above within 14 days of exercising his right of withdrawal.

The Customer shall use the following withdrawal form or any other similar unambiguous statement.
The exercise of the right of withdrawal shall not entail any penalty for the Customer.

However, Products that have been unpacked, scratched, incomplete, damaged, soiled or modified by the Customer will not be returned or exchanged. Only products in their original packaging and not worn or used may justify the exercise of a right of withdrawal.

If the above mentioned conditions are met, LE PETIT IBIZA will refund the Customer the amount paid for the returned Products within 14 days from the receipt of the Products. For the return of the Products, the Customer located in France can use the return form available in the order confirmation email or in his personal space. For other destinations, the shipping and return costs remain at the Customer’s expense. LE PETIT IBIZA will re-credit the bank account used to pay the order.

CONDITIONS OF USE

Access to the Site is free.
In order to navigate on the Site, the Visitor must have the equipment, software and parameters necessary for the proper functioning of the Site. The Internet user must have the skills, equipment and software required to use the Internet. The Visitor declares that he is fully aware of the characteristics and constraints of the Internet.
The Visitor acknowledges that the characteristics and constraints of the Internet do not make it possible to guarantee the security, availability and integrity of data transmissions during their circulation on the Internet. The Visitor therefore communicates them at his own risk.
The Company cannot be held responsible for any incidents that may arise from this transmission. In any event, the Visitor expressly acknowledges and agrees to browse the Site at his own risk and under his sole responsibility.
Furthermore, given the specific characteristics of the Internet network, the Company offers no guarantee of continuity of operation, being bound in this respect only by an obligation of means.
The Company cannot be held liable for any damage resulting from the temporary impossibility of accessing the Site.

The linked sites are not under the control of the Company, and the Company is not responsible for the content of these linked sites. It is the Visitor’s responsibility to make all verifications that he/she deems necessary or appropriate before proceeding with any transaction with one of these third parties.

INTELLECTUAL PROPERTY

lepetitibiza.com is a domain name protected in the same way as the elements appearing on its website. No one is allowed to reproduce, exploit, distribute or use in any way whatsoever, even partially, the elements of the site, except with the written agreement of LE PETIT IBIZA.

The use of the Site and its contents must be legal and responsible, and in no way harmful to the name, the reputation of LE PETIT IBIZA or its partners.

PROTECTION OF PERSONAL DATA

LE PETIT IBIZA collects and processes personal information and data from the Users, when they register or order on the Site, which are subject to computer processing maintained and operated by LE PETIT IBIZA for the following purposes

  • to manage the order of the Users ;
  • to manage the administrative, accounting and functional organization of the Site;
  • to allow the control of the compliance of the Users with the stipulations of the general conditions;
  • to enable the conclusion of partnerships;
  • to feed a statistical tool (for anonymous data).

The personal information and data collected and processed by LE PETIT IBIZA will only be used insofar as it is strictly necessary for the aforementioned purposes.

The personal information and data collected and processed by LE PETIT IBIZA are strictly intended for use by LE PETIT IBIZA, its staff and its specifically authorised partners in strict compliance with the aforementioned purposes and by the judicial and/or administrative authorities.

The information and personal data provided on the registration form are kept for the duration of the account and for a maximum of three (3) years after its closure, unless a retention period results from a legal or regulatory obligation, and in particular in the event of legal proceedings, or if the User has exercised one of the rights granted to him/her by the French law n°78-17 of January 6, 1978 called “Informatique et Libertés” (Data Processing and Liberties) and the General Regulation on the Protection of Personal Data of April 27, 2016.

At the end of these periods, the personal data concerning the User is archived in a secure manner until the expiry of the legal or regulatory retention and prescription periods.

LE PETIT IBIZA may collect, process and communicate the User’s personal data to its subcontractors for the purpose of operating the Service, including commercial companies for carrying out statistical studies on the use of the Services and the preferences of the Users in order to improve them.

The subcontractors are obliged to respect the confidentiality and security of the personal data that may be communicated to them and to use them only in the context of the execution of their mission. LE PETIT IBIZA guarantees that the personal data of the Users will not be disclosed to any unauthorized third party without the consent of the person concerned.

In accordance with the Data Protection Act and the General Regulation on the Protection of Personal Data, the User has the right to access, rectify, retrieve, oppose on legitimate grounds, delete, limit personal data concerning him/her, or define the fate of his/her personal data after his/her death or request its portability in the cases provided for by the law.

For any complaint, the User has the right to refer the matter to the National Commission for Data Processing and Liberties.

To exercise these rights, the User is invited to send an email to julien@lepetitibiza.fr or to send a letter to LE PETIT IBIZA – Responsable de la protection des données personnelles 19 bis rue Jouffroy d’Abbans 75017 PARIS, accompanied by a copy of his identity card.

LE PETIT IBIZA adopts sufficient, appropriate and relevant security measures in order to preserve the security of personal data and, in particular, to prevent them from being distorted, damaged or accessed by unauthorized third parties. These measures include, in particular, the implementation of procedures to protect the servers storing the personal data by firewalls, anti-spam and anti-virus filters and the encryption of personal data by an SSL protocol.

In accordance with articles L.223-1 et seq. of the French Consumer Code, if the User does not wish to be contacted by telephone on the number he/she had communicated to LE PETIT IBIZA, he/she can register at any time this telephone number on the list of opposition to telephone canvassing by Internet via the website www.bloctel.gouv.fr or by mail by writing to : Opposetel, Service Bloctel, 6 rue Nicolas Siret 10000 Troyes. This registration is free and valid for three years. However, LE PETIT IBIZA will be able to contact by phone the User who has expressly requested it, during a period freely determined by the User or, failing that, within a period of 3 months from the date of the User’s request.

APPLICABLE LAW AND SETTLEMENT OF DISPUTES

The present general terms and conditions of sale are subject to French law regardless of the country of delivery.

Except for provisions of public order, all disputes which could arise within the framework of the execution of the present GTC can be submitted to the appreciation of LE PETIT IBIZA for an amicable settlement before any legal action. In accordance with the provisions of the Consumer Code concerning the amicable settlement of disputes, LE PETIT IBIZA is a member of the consumer mediation body AME CONSO whose contact details are as follows: 11 place Dauphine 75001 PARIS or www.mediationconso-ame.com.

The Mediator may be contacted for any dispute that remains despite prior written request to LE PETIT IBIZA via the following form: https://www.mediationconso-ame.com/demande-de-mediation-ame.html. In any case, Customers may also submit their complaints via the European Commission’s platform for resolving consumer disputes: https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home2.show&lng=FR. The Commission will send the Customer’s complaint to the competent national mediator. It is expressly recalled that requests for amicable settlement do not suspend the time limits for taking legal action. In the absence of an amicable settlement, any dispute shall be subject to the jurisdiction of the French courts.
